Terms of Service

Please read these Terms of Service ("Terms") carefully before using the ODAC platform operated by ODAC ("us", "we", or "our").

1. Acceptance of Terms

By accessing or using our service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the service.

2. Description of Service

ODAC is a hybrid cloud ecosystem and management platform. You understand and agree that the Service is provided on an "AS IS" and "AS AVAILABLE" basis. ODAC does not guarantee continuous availability or error-free operation. You are solely responsible for maintaining your own backups. ODAC provides no backup or restoration guarantees for the data, applications, or configurations on your connected servers.

Beta Phase and Pricing: ODAC is currently in its Beta phase and is provided free of charge. However, we reserve the right to introduce paid subscription plans, modify usage limits, or change our pricing structure at any time in the future. We will provide at least 14 days advance notice to users before any such changes take effect, in accordance with Section 17 (Changes to These Terms).

3. Eligibility

ODAC is not directed or intended for use by individuals under the age of 16. To use ODAC, you must be old enough to consent to the processing of your information in your jurisdiction. We do not knowingly collect personal information from anyone under the age of 16. If you are a parent or guardian and become aware that your child has provided us with personal information, please contact us at support@odac.run. If we become aware that we have collected personal information from anyone under the age of 16 without verification or parental consent, we will take steps to remove such information.

If you are using ODAC on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

4. Privacy

Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using ODAC, you acknowledge that you have read and understood our Privacy Policy.

5. Accounts

When you create an account with us, you must provide information that is accurate and complete. You are responsible for safeguarding your magic link, tokens, and any connected third-party accounts (e.g., GitHub) used to access the service.

6. Subscriptions and Billing

Subscription Plans. Paid features of ODAC are offered as subscriptions billed in advance at the rates and intervals specified on our pricing page. All prices are listed in U.S. Dollars (USD) unless otherwise stated.

Automatic Renewal. Subscriptions automatically renew at the end of each billing period for the same duration at the then-current rate, unless you cancel before the renewal date. By subscribing, you authorize ODAC to charge your designated payment method for each renewal until you cancel.

Payment Methods. You are responsible for providing accurate and current payment information and for ensuring that your payment method remains valid. You authorize us to charge your payment method for all applicable fees, taxes, and renewals.

Failed Payments. If a payment fails, we will attempt to notify you and may retry the charge. If payment cannot be collected after a reasonable grace period, we may suspend or terminate your access to paid features without further notice. You remain responsible for any outstanding amounts.

Taxes. Prices are exclusive of any applicable taxes (such as VAT/KDV, sales tax, or withholding tax), unless otherwise stated. You are responsible for paying all such taxes, except those imposed on ODAC's net income.

Cancellation. You may cancel your subscription at any time through your account settings in the ODAC dashboard. Cancellation takes effect at the end of your current billing period — you will retain access to paid features until that date. We do not provide pro-rated refunds for partial billing periods.

No Refunds. All subscription fees are non-refundable, except where required by applicable law. By subscribing, you expressly acknowledge that the Service is a digital product delivered immediately upon payment, and where permitted by law, you waive any statutory right of withdrawal once the Service has been provided.

Price Changes. We may change subscription prices in accordance with Section 17 (Changes to These Terms), with at least 14 days advance notice. Price changes apply at your next renewal date.

7. Acceptable Use

You agree not to use ODAC for any unlawful purpose or to conduct any activity that would constitute a civil or criminal offense. You are responsible for the content and code you deploy using our platform.

8. Abuse Reports and Content Takedown

If you encounter content or activity on ODAC that you believe violates these Terms — including phishing, malware, illegal content, copyright infringement, or impersonation — please report it to abuse@odac.run.

What to include in your report:

  • The full URL or tunnel subdomain in question (e.g., example.odac.cc)
  • A clear description of the violation
  • Your contact information (so we can follow up if needed)
  • For copyright or IP claims: proof of ownership and a good-faith statement that the use is unauthorized

Our response:

  • Reports of phishing, malware, or content that poses an immediate risk to users will be reviewed and acted on as quickly as reasonably possible, typically within 72 hours
  • Other reports (including copyright claims) will be reviewed within a reasonable timeframe
  • We may, at our sole discretion, disable or remove the reported tunnel, suspend the responsible account, or take other action we consider appropriate
  • We are not obligated to disclose the outcome of an investigation to the reporter

Repeat violations may result in permanent account termination without notice. ODAC does not proactively monitor user content and relies on reports to enforce these Terms.

9. Tunnel Subdomains

ODAC provides tunnel subdomains (*.odac.cc) to expose your applications to the internet. By using this feature, you agree to the following:

  • Tunnel subdomains are provided on a first-come, first-served basis and remain the property of ODAC.
  • You may not use tunnel subdomains to impersonate other brands, organizations, or individuals.
  • Certain subdomains are reserved and cannot be claimed. Attempting to circumvent these restrictions may result in account suspension.
  • We reserve the right to reclaim, reassign, or disable any tunnel subdomain at our sole discretion, with or without notice.
  • Tunnel subdomains must not be used to host phishing pages, malware distribution, illegal content, or any activity that violates applicable laws.
  • Tunnel access is authenticated and IP-bound. Sharing or transferring tunnel access credentials is prohibited.
  • Content served through tunnel subdomains is entirely the responsibility of the user who created the tunnel. ODAC does not monitor, endorse, or assume any liability for the content, services, or applications accessible through tunnel subdomains.
  • ODAC may, at its sole discretion, disable or remove any tunnel that is reported for abuse, violates these Terms, or poses a risk to the platform or its users.

10. Connected Servers and Security Responsibilities

ODAC operates by connecting to your personal or third-party infrastructure via an installed agent. By connecting your servers to the ODAC platform, you acknowledge and agree to the following:

  • Server Security: You are entirely responsible for the underlying security, configuration, and maintenance of your connected servers. While ODAC may provide certain security tools or features (such as application firewalls or monitoring), the ultimate responsibility for your operating system updates, SSH access, and overall security posture remains with you.
  • Data Protection: You are exclusively responsible for maintaining independent backups of all data, databases, and applications residing on your servers. ODAC is not liable for any data loss caused by hardware failure, user misconfiguration, hacking, or actions executed via the ODAC platform.
  • Compromised Infrastructure: If your connected server is compromised, hacked, or used for malicious activities (e.g., DDoS attacks, crypto-mining, malware hosting), ODAC reserves the right to immediately disconnect the server's agent from our network and suspend your account without notice to protect the platform.

11. Intellectual Property

ODAC claims no intellectual property rights over the code, data, or content you deploy to your own connected servers. Your materials remain yours. By using the Service, you grant ODAC a limited, non-exclusive, worldwide license to access, process, and analyze your code and data solely for the purpose of operating, improving, and providing the Service. However, the ODAC platform, its dashboard, logos, and underlying infrastructure code are the exclusive property of ODAC.

12. Indemnification

You agree to defend, indemnify, and hold harmless ODAC, its affiliates, and its employees from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal and accounting fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or any content/services you expose through ODAC tunnels.

13. Third-Party Services

Our Service integrates with third-party platforms like GitHub. By connecting these services, you grant ODAC permission to access and interact with your repositories as required for the Service to function. You are solely responsible for ensuring you have the necessary rights to authorize such access and for complying with the terms of those third-party services.

14. Limitation of Liability

In no event shall ODAC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the service. This includes, without limitation: (i) infrastructure failures, misconfigurations, security breaches, or data loss occurring on the personal or third-party servers you connect to ODAC; and (ii) any damages arising from content or services made accessible through tunnel subdomains by other users.

15. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Antalya Courts and Enforcement Offices of the Republic of Turkey. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

16. Termination

Termination by You. You may close your account at any time through your profile settings in the ODAC dashboard. Upon account deletion, your active tunnels and agents will be disconnected immediately, and your account information, tunnel configurations, and associated personal data will be deleted within 30 days. We may retain certain information after account closure where required by applicable law (e.g., for tax, accounting, or legal compliance purposes), or in anonymized form for analytics and service improvement. Termination by Us. We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Effect of Termination. Upon termination, your right to use the Service ceases immediately. Released tunnel subdomains may become available for others to claim.

17. Changes to These Terms

We reserve the right to modify these Terms at any time. For material changes that significantly affect your rights, obligations, or pricing, we will notify you at least 14 days in advance via email or a prominent notice on our platform. All other changes, including those reflecting new features or bug fixes, are effective immediately upon posting. Your continued use of ODAC after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and close your account before the changes take effect.

18. General Provisions

Severability. If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and ODAC regarding the Service and supersede any prior agreements, communications, or understandings.

Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may freely assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.

Force Majeure. ODAC shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, cyberattacks, or major internet, telecommunications, or third-party infrastructure outages.
